Keeping your water system safe from a range of waterborne risks isn’t only a regulatory requirement, it’s quite literally a question of protecting people under your duty of care. So, what does compliance in water safety actually involve, and what does your business need to keep in mind to achieve it? Let’s break it down.

Compliance in Water Safety

Water safety compliance isn’t just a box-ticking exercise — it’s a structured, ongoing process that protects health and meets legal obligations. From understanding your role as a duty holder to implementing risk controls and maintaining proper documentation, each part plays a crucial role in keeping water systems safe. Let’s start by understanding exactly where your responsibilities begin.

Understanding Your Responsibilities

If you own, manage, or control brick and mortar premises, then you’re likely considered the “duty holder” under the law. Among other things, this means you’re responsible for making sure water systems are safe and well managed.

This includes arranging a Legionella risk assessment, putting in place control measures, and reviewing them regularly. All of this will need to be contained in a Water Safety Plan, and even if you delegate the day-to-day work to someone else, the legal responsibility still sits with you. Understanding your legal responsibilities as clearly as possible is the first step to staying compliant.

Carrying out a Risk Assessment

As with any form of risk management, you need to know what risks you need to mitigate before you can achieve compliance. Tasks such as a proper Legionella risk assessment are the foundation of effective water safety, but not all assessments are born equal.

It’s important to bring in a risk assessor who understands your type of building and how it’s used. A good assessor will be able to inspect your premises and help you build a clear, practical plan that reflects your regulatory responsibilities.

Planning Ongoing Work

One common mistake is to think that once the risk assessment has been done, the job is finished. But compliance in water safety is an ongoing process, and one you’ll need to keep coming back to.

You’ll need to keep up with ongoing inspections like temperature checks, flushing infrequently used pipes, cleaning systems, and logging all of this as you go along. If anything changes in the water system, whether that’s a new extension or part of the building being left unused, you may need to review your control measures.

Meticulous Record Keeping

Having a good record-keeping process is key to regulatory compliance. If a regulator or inspector visits, you’ll need to be able to prove that you’re a diligent duty holder, and that means showing them the evidence.

You’ll need to keep clear, dated logs of assessments and checks, evidence of employee training, and any reports you get from external water safety partners. In terms of compliance, these records are just as important as the issues they aim to prevent.

Staff Training and Awareness

Even the best water safety plan will fall short if the people responsible for carrying it out don’t understand what’s required. Proper training ensures that all your staff members, from maintenance personnel to facilities managers, are aware of the risks and know what actions to take. Particularly if they’re a lone worker.

Whether it’s learning how to perform routine temperature checks or recognising signs of system stagnation, investing in regular training sessions creates a culture of awareness and accountability. It also ensures your safety measures are implemented consistently, which reduces the risk of non-compliance or oversight.

Responding to Incidents Promptly

If something does go wrong, such as a positive Legionella test, a water system malfunction, or an unexplained illness, your response time matters. Having an incident response protocol in place is a vital part of compliance in water safety.

This should include isolating the affected system, notifying relevant authorities or health professionals, and carrying out any required remedial actions. Acting quickly not only protects health but also shows regulators that you take compliance seriously and are prepared to manage emergencies effectively.

Go With The Flow

Achieving regulatory compliance needn’t be too difficult, but it does require ongoing effort. By learning your legal responsibilities and working with a competent water safety partner, you should be able to ensure you remain on the right side of the law, and don’t get left high and dry.

    And here I thought I only needed to be concerned with the coffee and the coffee machine. But, this is ‘Crystal clear’ because water can still be a bacteria bath. Got to test like your operating license depends on it. (Because… it does.)
